In almost every conversation about AI in car dealerships, the same sentence comes up sooner or later: "We're not allowed to do that because of GDPR."
Sometimes that's true, often it isn't. Most of the time it's a mixture of justified caution, unclear legal positions and a blanket distrust of anything labelled "AI" that might come from the US.
The result is either paralysis – no AI deployment, for fear of the data protection officer – or the exact opposite: uncritical use of consumer tools like ChatGPT in customer communication, without anyone in the business knowing exactly what happens with the data.
Both extremes are wrong. AI can absolutely be used in a GDPR-compliant way in car dealerships – but only if you know the rules.
This article explains what those rules are, which mistakes happen most frequently and what decision-makers need to look for when selecting a solution.
AI deployment in car dealerships is GDPR-compliant if five conditions are met: a sound legal basis for processing, a data processing agreement with the provider, data hosting within the EU, the exclusion of data use for training third-party models, and transparency towards the customer. The EU AI Act supplements these requirements since 2024 with risk-based obligations that, for typical sales applications in dealerships, generally do not create additional hurdles.
Why the topic is particularly sensitive in automotive retail
Car dealerships process personal data in every lead workflow – name, contact details, vehicle preferences, often also information about occupation, income and creditworthiness.
For lease and finance enquiries, self-disclosures are added that can border on specially protected categories under the GDPR.
At the same time, this data flows through numerous systems: vehicle marketplaces, manufacturer lead tools, CRM, DMS, email inboxes. Every additional AI component in this web is, from a data-protection perspective, another processing operation that must be properly legitimised and documented.
On top of that: Germany's supervisory landscape is strict by European standards.
State data protection authorities have repeatedly objected to the use of certain AI tools in businesses in recent years – often not because of the AI itself, but because of missing data processing agreements, unclear data transfers to third countries or insufficient transparency towards data subjects.
These mistakes are avoidable, but only if you know about them.
The GDPR fundamentals for AI use in car dealerships
The GDPR does not impose fundamentally different requirements on AI use than on any other data processing.
That is the good news: there is no "AI paragraph" that makes everything more complicated. The familiar principles still apply – but they need to be thought through particularly carefully when deploying AI.
Clarify the legal basis
Every processing of personal data requires a legal basis under Article 6 GDPR.
In a typical dealership lead process, Article 6(1)(b) (pre-contractual measures) usually applies: the prospect has enquired about a vehicle, and processing their enquiry is part of initiating a potential purchase contract.
No separate consent is needed for this processing – the AI assistant may handle the enquiry, ask follow-up questions and supplement data, as long as this serves the contract initiation.
The situation is different for the reactivation of old leads or for outreach to lease maturities. Here the legal basis is usually Article 6(1)(f) (legitimate interest) – which requires a documented balancing of interests – or a previously obtained consent for promotional contact.
Both must be properly documented in the process.
Properly regulate data processing agreements
As soon as an external AI provider processes personal data on behalf of the dealership, this constitutes processing on behalf under Article 28 GDPR.
The dealership mandatorily needs a data processing agreement (DPA) with the provider. This contract must specify which data is processed, for what purpose, for how long, in which country and under what technical and organisational measures.
Without a DPA, any data transfer is a formal violation – regardless of whether the solution is technically sound.
Using ChatGPT, Gemini or Claude in customer communication without a data processing agreement and without a verified business version is one of the most common GDPR violations in German mid-market companies. The free or consumer version of these tools must not be fed with personal customer data in regular operations – neither by a salesperson "quickly" drafting an email, nor in a self-built automation script.
Data hosting and third-country transfers
Since the Schrems II ruling by the CJEU, the transfer of personal data to the US is only permitted under strict additional conditions.
The EU-US Data Privacy Framework of 2023 has eased the situation somewhat but has not fully resolved it. German supervisory authorities continue to recommend processing personal data within the EU wherever possible – ideally in Germany.
For AI solutions this means: if the models run on US cloud infrastructure and data flows there, additional effort is needed to make the processing legally secure.
Solutions with infrastructure operated entirely in Germany avoid this problem.
Transparency towards the customer
Under Article 13 GDPR, data subjects must be informed at the time of data collection about who processes their data and how.
When deploying an AI assistant, this means: the dealership's privacy policy must mention the AI deployment, name the provider, describe the purpose and point to the rights of data subjects.
This is not a marketing text but a legal obligation – and it is often forgotten when deploying AI.
No use for model training
A point not explicitly regulated by the GDPR but decisive in practice: is customer data used by the AI provider for training its own or third-party models?
With consumer AI this is often standard, with professional B2B solutions it must not be.
The DPA should expressly exclude dealership data from flowing into training pipelines – and the provider should be able to demonstrate this both technically and contractually.
If an AI provider cannot clearly and in writing confirm that data is neither used for training its own models nor passed on to third parties, the solution is not suitable for use in a car dealership. This assurance belongs in the DPA – not in a marketing brochure.
The EU AI Act – what's new
Since August 2024, the EU AI Act applies in addition to the GDPR.
Many dealership decision-makers confuse the two frameworks or believe the AI Act replaces the GDPR – both are wrong. The GDPR regulates the handling of personal data. The AI Act regulates the use of AI systems as such, regardless of whether personal data is involved.
Both apply in parallel.
The AI Act follows a risk-based approach: the higher the risk of an AI application, the stricter the obligations.
Dealership applications such as lead qualification, automated email responses or old-lead reactivation typically fall into the "limited risk" category. This primarily means a transparency obligation: customers must be able to recognise that they are communicating with an AI and not a human.
In practice, a corresponding note in the automated communication or a mention in the privacy policy is sufficient for this.
It becomes more critical with AI systems that make decisions about people – for example automatic creditworthiness assessments or the rejection of finance applications without human review. Such applications can be classified as "high-risk AI" and are then subject to considerably stricter obligations.
For the vast majority of sales applications in car dealerships, however, this is not an issue as long as the final decision – offer, finance approval, contract conclusion – remains with a human.
As long as an AI assistant in a dealership prepares communication and collects information but does not make binding decisions about customers, it operates within the limited-risk area of the EU AI Act. The most important new obligation is transparency: the customer must know they are speaking with an AI.
The seven most common mistakes when using AI in car dealerships
From conversations with dealerships, data protection officers and supervisory authorities, seven patterns can be identified that repeatedly cause problems in practice.
1. Consumer AI in regular operations
Salespeople use ChatGPT, Gemini or similar consumer tools to draft email replies to customers – copying complete lead data including name, contact details and vehicle preferences into the input field.
Without a business contract and DPA, this is a clear GDPR violation.
2. Missing data processing agreement
The AI solution is technically sound, but nobody has signed a DPA.
In an audit by the supervisory authority, this is the first point that will be objected to.
3. Unclear data location
The dealership does not know where the data is actually processed.
"Cloud" is not an answer – the authority wants to know in which country, with which provider, under which legal framework.
4. No transparency towards customers
The privacy policy has not been updated in years, AI use does not appear in it.
The AI Act obligation to label automated communication is also often overlooked.
5. Unclear legal basis for old-lead reactivation
The dealership automatically reactivates leads that in some cases have not been contacted for years – without checking whether valid consent still exists or whether the legitimate-interest balancing holds.
6. No deletion concepts
The AI collects and stores data, but nobody has defined when which data is deleted.
Article 5 GDPR (storage limitation) is thereby violated.
7. Confusing provider and controller responsibility
The dealership relies on the assumption that "the provider will take care of data protection".
In fact, the dealership remains legally responsible as the controller under Article 4 GDPR – the provider is merely the processor.
Checklist for selecting a GDPR-compliant AI solution
Before a dealership introduces an AI solution, the following points should be clarified and documented.

Coordination with the data protection officerBefore implementation, the internal or external data protection officer was involved and has approved the solution. The approval is documented.

A solution that responds to these questions with marketing slogans is not. That distinction is as simple as it is important.
